Advanced Air Permitting in New York – PSD/NSR and Toxic Air Contaminants

This course focuses on two advanced air permitting topics in New York: 1) requirements for major sources and major modifications to existing facilities, and 2) requirements for evaluation of toxic air contaminants. Nonattainment New Source Review (NNSR) and Prevention of Significant Deterioration (PSD) in 6 NYCRR Part 231 will be reviewed, including the requirements to determine your project’s emission potential, perform a netting analysis and conduct air dispersion modeling. Additionally, all air permit modifications and renewal applications must address recently revised requirements under Part 212. The process for demonstrating compliance with Part 212 requirements during the permitting process has become more substantial. Specific topics to be covered are:

  • Applicability of Part 231 based on existing facility location and existing major source status.
  • Process for determining if your modification / construction will result in a ""significant"" project.
  • Evaluating when a net emission increase assessment is required, and how to complete one.
  • Requirements for emissions offsets and how to identify potential sources.
  • How to generate Emission Reduction Credits, and how they may affect future projects.
  • Requirements for emissions of Air Toxics under Part 212.
  • Strategies to consider when applying for a permit for your new or modified facility or renewing your current permit to streamline the requirements to demonstrate compliance for your facility.
  • Air dispersion modeling requirements and expectation to evaluate your project’s off-site impact relative to the NAAQS, Significant Impact Levels and PSD Increments (NNSR) and guideline concentrations (Part 212).
